ViyuSMS - Terms & Conditions
Effective Date: 22nd September 2025 These Terms & Conditions (“Terms”) govern your access to and use of the ViyuSMS platform, a service owned and operated by Viyu Ventures Limited (“Company,” “we,” “our,” or “us”). By registering for or using our bulk SMS services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our services. 1. Definitions “Service” refers to the ViyuSMS bulk SMS platform and related solutions. “User,” “you,” or “your” refers to the individual or entity using the Service. “Message Content” refers to the SMS text, sender ID, and any other related data submitted for delivery. 2. Eligibility You must be at least 18 years old to use the Service. You represent that you have the authority to enter into this agreement on behalf of yourself or your organization. 3. Use of Services By using ViyuSMS, you agree to: Provide accurate and complete registration information. Be responsible for maintaining the confidentiality of your account credentials. Ensure that all Message Content complies with applicable laws, regulations, and industry guidelines. Not use the Service for spamming, fraudulent activity, or sending prohibited content (e.g., illegal, abusive, defamatory, obscene, or harmful material). 4. Message Delivery We will make commercially reasonable efforts to deliver messages to intended recipients via telecom operators. We do not guarantee delivery times, as successful delivery depends on operators, recipient networks, and other factors beyond our control. Delivery reports (where available) will be provided but may not always be accurate due to third-party dependencies. 5. Fees and Payments All fees for SMS services are as per the pricing agreed at the time of subscription or purchase. Payments must be made in advance unless otherwise agreed in writing. Fees are non-refundable except where required by law. Users are responsible for all charges related to message submission, whether delivered or not, once messages have been submitted to the platform. 6. Prohibited Activities You agree not to use ViyuSMS for: Sending unsolicited bulk SMS (“spam”). Distributing messages that contain malware, phishing, or harmful content. Violating telecom regulations or anti-spam laws in any applicable jurisdiction. Impersonating another person, company, or entity without authorization. 7. Data Protection & Privacy We collect and process user data in accordance with our Privacy Policy. By using the Service, you consent to such collection and processing. You are responsible for ensuring that the phone numbers and data you provide are collected lawfully with proper consent. 8. Service Availability We strive to ensure that the Service is available 24/7. However, we do not guarantee uninterrupted access and may suspend or limit services for maintenance, upgrades, or technical issues. 9. Intellectual Property All software, designs, logos, trademarks, and content associated with ViyuSMS are the property of Viyu Ventures Limited. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent. 10. Limitation of Liability We provide the Service on an “as-is” and “as-available” basis. We shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability, in any case, shall not exceed the fees paid by you for the Service in the last 3 months. 11. Indemnification You agree to indemnify and hold harmless Viyu Ventures Limited, its affiliates, employees, and partners from any claims, damages, or liabilities arising from: Your use of the Service. Your violation of these Terms. Your violation of any applicable law or regulation. 12. Suspension and Termination We reserve the right to suspend or terminate your account immediately if you: Breach these Terms. Engage in prohibited or unlawful activities. Fail to make timely payments. 13. Changes to Terms We may modify these Terms from time to time. Updates will be posted on our website with the revised effective date.
